Presto Assistant is a member of the Student Data Privacy Consortium (SDPC). The SDPC created the National Data Privacy Agreement (NDPA), of which Presto Assistant is a signatory. If you'd like Presto Assistant to sign an NDPA for your state, please reach out to billing@presto-assistant.com.

The Student Data Privacy Consortium sets out to:

• Establish a community of stakeholders who have various needs addressed through policy, technology and/or effective practice sharing around effective privacy management
• Development of tools and resources to address operational issues not currently being addressed
• Development of a clearinghouse of student data privacy operational issues and resources to support schools, districts, states and vendors in managing those issues, no matter where the resources originate
• Identify projects that have on-the-ground and real-world impact on student data privacy enabling schools, districts, vendors, and states to find resources, adapt them to their unique context, and implement needed protections
• Leverage partnership organizations working in the privacy space to have their good work utilized and no reinvention of existing work

Presto Assistant is a signatory of the Secure by Design Pledge, developed by The White House, the Department of Education, and the Cybersecurity and Infrastructure Security Agency (CISA).

This pledge reinforces Presto's commitment to making products that are both secure-by-design and secure-by-default, all in the service of protecting data for students and districts.

With a shared mission to leverage data to create better outcomes for students, save time for teachers, and increase efficiencies for schools, several organizations have come together to create Project Unicorn, an effort to improve data interoperability within K-12 education.

Presto Assistant commits to providing secure access, privacy, and interoperability in our products while empowering customers, educators, and families to achieve an enhanced level of engagement in their students' education. In accordance with the data interoperability initiatives set forth by Project Unicorn, Presto pledges to:

Presto Assistant complies with the Web Content Accessibility Guidelines, WCAG 2.1 Level AA as accepted by the Section 508 of the Rehabilitation Act and the Americans with Disabilities Act (ADA).

Presto Assistant complies with the Illinois Student Online Personal Protection Act (SOPPA), 105 ILCS 85.

Presto Assistant has also signed the SDPC National Data Privacy Agreement with the Illinois exhibit (IL-NDPA). If you are at a school in Illinois, please contact billing@presto-assistant.com to sign onto the IL NPDA with our company.

• The Presto deletion policy is compliant with SOPPA, mentioned in our Terms of Service.
• Presto Assistant will notify districts within 30 days if there is a “Breach” (as defined in SOPPA).

In the Kentucky Senate Bill 181 (SB 181), effective on 6/27/2025, several key requirements were enacted:

• Traceable Communication Only: All communication must occur through platforms that create a permanent, reviewable record.
• Personal Messaging Prohibited: Staff may not use personal text, email, or private messaging apps (e.g., Snapchat, WhatsApp, Facebook Messenger).
• Approved Platforms Only: All communication must go through district-approved systems.

Presto Assistant complies with SB 181 in that all communication sent through the Presto system is always fully visible to administrators. If your district does not intend to use the communication features of Presto Assistant, you can disable those features.

Presto Assistant abides by Minnesota Statute 13.32 Educational Data, Subd. 13 for Technology providers (statute link).

In the Texas Senate Bill 12 (SB 12), effective on 9/1/2025, section 10 amends the Texas Education Code with the following:

Presto Assistant complies with SB 12 in that all communication sent through the Presto system is always fully visible to administrators.
